Refuse the Breath Test?First refusal is a one year suspension with out restricted license unless you install ignition interlock ($3,000.00 to $4,000.00) vs. reading of .08% to .1999% is 180 day suspension with only first 30 days with out restricted license and interlock not required thereafter. You are better off taking the test if first offense and less than .20%, after which suspension is two years and interlock required for restricted license. Second refusal is two year suspension anyway and probably don't want to refuse twice unless charged with second offense DUI. Number of Drinks (beer, 4oz wine, one shot hard liquor) for % reading is for average size male: .02% only takes one, .08% two probably OK and three probably over the limit; .15 Three probably OK and Four probably not; .2% Four probably OK and Five probably not. The legnth of time from first drink and between drinks makes a difference, i.e. the longer the better, body will process one drink out about every four hours. Varies for individuals with different size and tolerance levels with women usually reading higher than men.
Don't take the field sobriety test if you don't think you can pass it or plan to refuse breathilizer test! They will use it against you to convict in court.
AVOID BEING PULLED OVER:
Don't drive after more than two drinks. Set cruise control near speed limit. Always use turn indicator to change lanes. Don't leave bright lights on. Set AC on high in face to stay sharp. Don't slow down too soon to stop. Follow and obey all trafic signals and laws. Aviod license check points.
Pulled over when drinking. Stay in car unless told to get out. Take breath mints, gum, etc. Don't talk any more than absolutely necessary. Don't walk, stand or lean on anything. Sit because so nervous legs are weak. Never admit to having anything to drink ! (not one not two)
Always file for an Administrative Hearing within fifteen days to oppose administrative suspension for refusal or test results and subpeona all officers (if just one doesn't show, you win).
